2. Information we collect

Depending on how you use our store, we may collect:

  • Identity and contact information, including your name, billing and delivery address, email address and telephone number.
  • Order and account information, including products viewed or purchased, order history, returns, exchanges, discounts and account details.
  • Payment and transaction information. Payment providers collect the payment details needed to process your payment. We normally receive confirmation, transaction references and limited payment information rather than full card details.
  • Communications, including emails, contact-form messages, customer-service enquiries, return requests and data-protection complaints.
  • Reviews and user content, including ratings, review text, names or display names, photographs and other content you choose to submit.
  • Marketing information, including subscriptions, consent records, communication preferences and engagement with marketing messages.
  • Device and usage information, including IP address, browser and device type, cookie or similar identifiers, pages viewed, searches, cart activity, referring pages and interaction with our website and advertisements.
  • Security and fraud information, including login, transaction, device and risk signals used to protect customers, payments and our store.
  • Inferences and audience information, such as likely interests or audience segments created from browsing or purchase activity, where permitted and, where required, only after consent.

We collect information directly from you, automatically from your device, and from Shopify, payment providers, delivery providers, advertising platforms and the apps used to operate our store.

3. How and why we use information

We use personal information for the following purposes and lawful bases:

  • To provide our store, process payments, fulfil and deliver orders, manage accounts, returns, exchanges and refunds, and provide order-related support. We rely on performance of our contract with you and steps taken at your request before entering a contract.
  • To keep accounting, transaction and business records, manage product-safety or recall issues, respond to lawful requests and meet regulatory duties. We rely on legal obligations.
  • To protect our customers and store, authenticate users, prevent fraud, investigate misuse and maintain technical security. We rely on our legal obligations and legitimate interests in operating a secure business and protecting customers.
  • To answer enquiries, resolve complaints and improve customer service. We rely on our contract with you where the enquiry concerns an order, and otherwise on our legitimate interests in providing effective support.
  • To obtain and publish genuine reviews and other content you choose to submit. We rely on our legitimate interests in obtaining customer feedback and helping customers make informed choices. Where consent is required for particular content or use, we will ask for it.
  • To provide contextual product recommendations, operate upsell or cross-sell features and improve our products and store. We rely on legitimate interests where recommendations are based only on the page, product or cart being viewed. We use consent where recommendations rely on tracking or profiling across visits, websites or devices.
  • To send marketing by email, SMS or similar channels. We rely on consent, or where legally permitted, our legitimate interests together with the existing-customer “soft opt-in”. You can object or unsubscribe at any time.
  • To measure and improve website performance. We rely on consent for non-essential analytics. We would only use analytics without consent where it is configured solely to produce aggregate statistics for improving the site, meets the applicable legal exception, and provides a simple and free way to object.
  • To provide personalised advertising, create audiences, measure advertisements and track activity across websites or devices. We rely on consent.
  • To establish, exercise or defend legal claims. We rely on our legitimate interests and, where applicable, legal obligations.

Where we rely on legitimate interests, those interests include operating and securing our store, providing customer support, improving services, obtaining genuine feedback, preventing fraud and promoting our products. We consider the likely impact on your rights before relying on this basis.

Information required to process an order is necessary to enter into or perform our contract with you. If it is not provided, we may be unable to accept, fulfil or deliver the order. Marketing information and optional cookie consent are not required to place an order.

4. Shopify and Shopify Network Intelligence

Our store is hosted by Shopify. Shopify processes personal information when you browse or purchase from our store, including to provide hosting, checkout, payment, security, analytics and other commerce services.

Shopify Network Intelligence is enabled for our store. This means Shopify may securely use information about your interactions with our store together with information from your interactions with Shopify and other Shopify merchants to provide Enhanced Services. These may include improved personalisation, search, store performance, security, fraud prevention, analytics and advertising. Other merchants do not receive access to our customer data.

For core store services Shopify generally processes information on our behalf. For some Enhanced Services, Shopify may process information for its own purposes as described in the Shopify Consumer Privacy Policy.

Where required, Shopify’s non-essential processing must be controlled through a valid consent system connected to Shopify’s Customer Privacy system. If you reject non-essential technologies through such a system, Shopify states that it marks relevant device data so that it is not used by Shopify Network Intelligence for non-essential purposes. You may also exercise rights directly with Shopify through the Shopify privacy portal.

5. Who receives information

We disclose only the information reasonably needed for the relevant purpose. Recipients may include:

  • Shopify, for hosting, checkout, commerce administration, security, analytics, payments and Enhanced Services.
  • Payment providers and financial institutions, to authorise payments, process refunds, manage chargebacks and prevent fraud. The provider available to you is shown at checkout.
  • Postal, courier, fulfilment and delivery providers, to deliver and track orders and manage delivery issues.
  • Omnisend, for marketing subscriptions, email or SMS campaigns, automation and related analytics.
  • Judge.me, for collecting, managing and displaying product reviews and sending review requests.
  • Selleasy, for relevant product recommendations and upsell or cross-sell functions.
  • Return Prime, for managing returns, exchanges and refunds.
  • Meta, including Facebook and Instagram; Google and YouTube; and TikTok, for advertising, audience creation, social or video features and conversion measurement where you consent.
  • Website, cloud, email, security, analytics and technical-service providers that support our business.
  • Professional advisers, including accountants, insurers and legal advisers.
  • Regulators, courts, law-enforcement bodies or other authorities where disclosure is required or legally permitted.
  • A buyer, investor or successor organisation if all or part of our business is sold, reorganised or transferred, subject to appropriate confidentiality and data-protection safeguards.

Some providers act as processors on our instructions. Others may act as independent or joint controllers for particular services. Their own privacy notices explain how they use information for their purposes.

We do not receive money in exchange for customer personal information. Advertising technologies can involve disclosure to advertising partners, but we use them only with consent where required.

6. International transfers

Shopify and some of our service, payment, marketing and advertising providers operate internationally. Personal information may therefore be processed outside the United Kingdom or European Economic Area, including in countries with different data-protection laws.

Where transfer restrictions apply, we use an approved legal mechanism, such as:

  • a UK or European adequacy decision;
  • the UK International Data Transfer Agreement or UK Addendum;
  • European Commission Standard Contractual Clauses; or
  • another legally permitted safeguard.

We also consider whether additional contractual, technical or organisational protections are needed. Contact us if you would like more information about the safeguard used for a particular transfer.

7. How long we keep information

We keep personal information only for as long as reasonably needed for the purpose for which it was collected. We use the following criteria:

  • Orders, payments, returns and account information: for the customer relationship and afterwards for the period needed to meet accounting, tax, consumer-protection and other legal duties, manage chargebacks, prevent fraud, resolve disputes and establish or defend claims.
  • Customer-service enquiries, rights requests and complaints: until the matter is resolved and afterwards while the record is reasonably needed for related legal, regulatory or complaint-handling purposes.
  • Marketing records: while you receive marketing or until consent is withdrawn or you object. We may keep minimal suppression information for as long as needed to ensure we continue to respect an opt-out.
  • Reviews and submitted content: while published or reasonably useful for maintaining an authentic review history, unless removal is required or justified.
  • Cookie, preference and consent information: for as long as the relevant technology remains necessary and, where consent applies, for as long as reasonably needed to record and demonstrate your choices.
  • Security and fraud records: for the shortest proportionate period needed to detect, investigate and prevent security incidents or fraud.
  • Backups: until overwritten through our normal backup cycle.

We delete or anonymise information when it is no longer required. Providers may retain information under their own documented retention requirements.

8. Marketing choices

We may send marketing where you have consented. We may also market our own similar products to an existing customer where we obtained the contact details directly during a sale or genuine sale negotiation and gave a clear opportunity to opt out both when collecting the details and in every later message.

You can unsubscribe using the link in a marketing message or by emailing info@modapaws.com. Withdrawing consent or opting out does not affect essential service messages about an order, payment, return, account, safety issue or policy change.

9. Cookies and similar technologies

We use or may use cookies, pixels, tags, scripts, local storage and similar technologies. These can remember choices, keep the store secure, operate the cart and checkout, measure use and support advertising.

Advertising and marketing Personalised advertising, audience creation, cross-site or cross-device tracking, advertising conversion measurement and marketing engagement. Providers may include Meta/Facebook/Instagram, Google/YouTube, TikTok, Shopify Network Intelligence and Omnisend. These are optional and require consent before they are stored, accessed or activated.

For visitors in the United Kingdom and European Economic Area, our Shopify cookie banner offers Accept, Decline and Manage preferences. Optional analytics, advertising, profiling and other tracking that requires consent must remain disabled unless and until you choose Accept or enable the relevant category through Manage preferences.

Merely visiting or continuing to use the website does not constitute consent. Decline rejects optional categories, while Manage preferences lets you choose by purpose. Declining optional technologies does not prevent you from browsing the store or placing an order, although a feature that depends on an optional technology may not operate.

After making a choice, you can reopen Cookie preferences through Shopify’s policy or footer controls where available and change or withdraw your consent. Withdrawal applies to future optional storage, access and processing and does not make earlier lawful processing unlawful. You may also block or delete cookies through your browser settings, although browser controls may not communicate your choice to every provider.

Strictly necessary technologies may be session-based or may remain for the limited period needed to provide security, cart, checkout, payment or privacy-choice functions. Before any optional technology is used with consent, information about its provider, purpose and lifespan must be made available to you.

10. Profiling and automated decisions

Advertising and analytics providers may use information to create audience or interest profiles, subject to your consent where required. We do not intend to make decisions about you based solely on automated processing that produce legal or similarly significant effects.

Payment and fraud-prevention providers may generate automated risk indicators. Where a decision would have a legal or similarly significant effect, we will provide the information and safeguards required by law, including human review where applicable.

11. Your rights

Depending on the circumstances and applicable law, you may have the right to:

  • request access to your personal information;
  • correct inaccurate or incomplete information;
  • request erasure;
  • restrict processing;
  • object to processing;
  • receive certain information in a portable format;

These rights are not absolute and may be subject to legal exceptions. We may ask for information needed to verify your identity or authority to act for another person. We normally respond within one month, subject to any lawful extension.

Please explain what happened, which information or activity is involved, the outcome you would like, and any relevant order or correspondence reference. We may ask for proof of identity or authority where reasonably necessary.

We will:

  • acknowledge your complaint within 30 days of receiving it;
  • investigate it appropriately and without undue delay;
  • keep you informed of progress; and
  • tell you the outcome without undue delay.

You may complain to the UK Information Commissioner’s Office through its complaints service. If EU or EEA data-protection law applies, you may also complain to the supervisory authority where you live, work or believe an infringement occurred. 14. Security

We use appropriate technical and organisational measures designed to protect personal information against loss, misuse, unauthorised access, alteration and disclosure. Access is limited to people and providers that need it for authorised purposes. No internet transmission or storage system can be guaranteed completely secure.

15. Children

Our store is intended for people able to enter into a purchase contract. We do not knowingly target children or use children’s information for behavioural advertising. If you believe a child has provided personal information inappropriately, contact us so that we can investigate and take appropriate action.
